QUEENS - A Queens man has been indicted on charges he fatally stabbed a man during a gang fight in Astoria four years ago. The suspect had been at large for years but was picked up last month when an officer arrested him for vaping on a Brooklyn subway, the Queens DA announced. 



Luis Hernandez, 36, of Maspeth, Queens, was charged today with murder and gang assault in the 2020 fatal stabbing in Astoria. Hernandez faces up to 75 years to life in prison if convicted. He 


was charged with murder in the second degree, gang assault in the first degree, two counts of attempted murder in the second degree, two counts of attempted gang assault in the first degree and assault in the second degree. 


“A young man’s life was cut short in a brutal act of violence four years ago,” said Queens District Attorney Melinda Katz. "His killers may think they got away with murder, but we will use every tool at our disposal to bring them to justice, no matter how much time has passed.” 



Prosecutors said Hernandez was arrested last month when he was caught vaping inside the 59th Street subway station in Brooklyn. During a records search following Hernandez’ arrest, cops discovered he was a suspect in the 2020 stabbing. 


At around 8:20 pm on February 9, Richard Hernandez, 21 was fatally stabbing in front of 36-30 31st Street in Astoria. 


Hernandez and two others were assaulted by a group of at least three men who punched and stabbed Hernandez, and his friends. The attackers punched and stabbed Hernandez and a third suspect who survived. 



Police recovered a machete and two, switchblade-style knives at the scene. 


Luis Hernandez had been identified as a suspect in the fatal stabbing. However the other accomplices have not been identified.
